1. Agreement to Terms

By accessing or using SafeGuard Workers UK ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and SafeGuard Workers UK. Please read them carefully before using our Service.

2. Service Description

SafeGuard Workers UK is a secure, confidential platform designed to help UK workers document and report workplace incidents, including but not limited to:

  • Workplace violence and abuse
  • Safety incidents and hazards
  • Discrimination and harassment
  • Other workplace-related incidents

The Service provides tools for documenting incidents, accessing resources, downloading template letters, and understanding your employment rights in the UK.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Be a worker in the United Kingdom
  • Provide accurate and truthful information when registering
  • Comply with all applicable laws and regulations
  • Not have been previously banned from using the Service

By registering, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

4.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Acceptable Use

You May:

  • Use the Service for its intended purpose of documenting workplace incidents
  • Access and download your own reports and data
  • Use template letters and resources for your personal use
  • Share your own reports with authorized parties (employers, legal representatives, etc.)

You Must Not:

  • Submit false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Access or attempt to access other users' accounts or data
  • Use the Service for any illegal purpose or in violation of any laws
  • Upload malicious software, viruses, or harmful code
  • Attempt to reverse engineer, decompile, or hack the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) to access the Service
  • Share your account credentials with others
  • Use the Service to harass, threaten, or harm others

6. User Content & Data

6.1 Ownership

You retain ownership of all content and data you submit to the Service, including incident reports, uploaded files, and other information. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

6.2 Content Responsibility

You are solely responsible for:

  • The accuracy and truthfulness of all information you submit
  • Ensuring you have the right to upload any files or documents
  • Complying with all applicable laws when submitting content
  • Not infringing on the rights of others (privacy, copyright, etc.)

6.3 Content Removal

You may delete your content at any time. We reserve the right to remove content that violates these Terms, is illegal, or poses a risk to the Service or other users.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, features, functionality, and content (excluding user-submitted content), is owned by SafeGuard Workers UK and protected by UK and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. Template letters and resources are provided for your personal use only.

9. Service Availability & Modifications

We strive to provide a reliable service, but we do not guarantee that the Service will be available at all times or free from errors, interruptions, or defects. We may:

  • Modify, suspend, or discontinue the Service at any time
  • Perform maintenance that may temporarily interrupt service
  • Update features, functionality, or content
  • Impose limits on usage or access

We will provide reasonable notice of significant changes or service interruptions when possible.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to use the Service (currently £0, as the Service is free)
  • We are not responsible for any loss or damage resulting from:
    • Unauthorized access to your account
    • Service interruptions or technical failures
    • Errors or omissions in content
    • Decisions made based on information from the Service

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless SafeGuard Workers UK, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service

13. Termination

You may terminate your account at any time by deleting it through the Service or contacting us. We may terminate or suspend your access immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Misuse the Service or harm other users
  • Fail to pay any fees (if applicable in the future)

Upon termination, your right to use the Service will cease immediately. We may delete your account and data in accordance with our Privacy Policy.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a dispute, we encourage you to contact us first to resolve it amicably. If we cannot resolve the dispute, you may bring proceedings in the courts of England and Wales.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeGuard Workers UK regarding your use of the Service and supersede all prior agreements and understandings.
